Descrizione: [Abstract] This paper attempts to show the implications of the concept of lex used by Cicero in Leg. I, 18-19. Lex is the juridical form adopted by the ius in the republic of the maiores, as described by Scipio in De re publica, and is modelled by the fusion of the principles that define the mixed government: the monarchical, materialised in the rogatio of the magistrate; the democratic, deployed through its approval in the elections; and the aristocratic, legitimating as ius the content of the lex through an interpretative process resulting from the application of the science of law. The balance between these three principles ensures the distributive and equitable character of the lex, which, understood in these terms, constitutes summa ratio, insita in natura, quae iubet ea quae facienda sunt, prohibetque contraria.
