Description: The paper deals with the ‘essenziale gratuità’ (art. 1803 cod. civ.) of the gratuitous loan in modern law and with the difficulties it poses, to develop some remarks on the commodatum in Roman law. The core of the research is the study of the social and ethical aspects of the bailment, alongside the juridical one, as they emerge in Paul. 29 ad ed. D. 13.6.17.3. In particular, we focus on the exegesis Cic. fin. 2.35.117: the source presents an interesting comparison between commodare and beneficium, and also the mention to the connection between beneficium and gratia, that could be a key to explain the relationship between the bailor and the baile.
